1. Data controller and contact
Menyah Proyectos, S.A. de C.V., operating under the MODECO brand, with its address at Av Luis Donaldo Colosio, Mz 31 Lt 1 int Bod 16-S, CP 77500 Cancún Quintana Roo, is responsible for processing personal information collected through its contact form.
For any privacy-related matter, contact hola@modeco.mx.
2. Information we collect
The form requests your name, email address, project location, type of solution required, and project description. You may also provide your company or practice, telephone number, and approximate project area.
We retain your consent preferences. Technology providers may process technical information, such as your IP address, browser, and submission date, to operate the service and prevent abuse.
We do not request sensitive personal information or banking information through this form. Please avoid including these, identity documents, or other people’s information that is unnecessary for your inquiry.
3. How we use your information
Primary purposes: responding to your inquiry, assessing your needs, preparing quotations, contacting you, and following up on the project you requested.
Optional purpose: sending MODECO news, product and service information, or promotional communications, exclusively if you select the commercial communications checkbox. This checkbox will be unchecked by default.
Declining commercial communications will not affect how we handle your inquiry. You may unsubscribe at any time by emailing hola@modeco.mx with the subject “Unsubscribe from commercial communications”.
4. Who may access your information
Access within MODECO will be limited to authorized personnel who need the information to handle your request.
We will use Formspree to receive and route form submissions, together with necessary email and hosting providers. At this stage, inquiries will not be added to marketing agencies’ systems or CRM platforms.
Formspree states that it may process information in the United States and other countries where it operates. Processing therefore does not take place exclusively in Mexico. Its policy is available at https://formspree.io/legal/privacy-policy/.
MODECO will not sell your information or provide it to third parties for their own marketing campaigns. Any disclosure beyond what is necessary to provide these services or meet an applicable obligation will be assessed beforehand and will require your consent where applicable.
5. Retention
Inquiries that do not result in a contract will be retained for 12 months after the last contact. They will then be deleted or anonymized, except for information that must be retained to meet applicable obligations or address outstanding liabilities; access to that information will be restricted.
If a project proceeds, the necessary information will become part of the relevant project file and will be retained in accordance with applicable contractual and legal obligations. The specific retention period will be established for that file.
A minimal marketing subscription record will be retained while your authorization remains in effect. When you unsubscribe, we will stop using it for promotions and may retain only what is necessary to honor your choice.
Deletion procedures must cover copies under MODECO’s control, including the receiving mailbox and the form provider’s records.
6. Privacy rights and requests
You may request access, rectification, cancellation, or opposition to processing (ARCO rights under Mexican law), withdraw consent, or limit use and disclosure by contacting hola@modeco.mx.
Provide your name, reply contact, request, and information identifying the record. ARCO requests require identity verification and, where relevant, proof of representation; correction requests should specify the change and supporting information.
We will communicate our determination within 20 business days and, if granted, implement it within the following 15 business days, subject to legally permitted, justified extensions. Access may be provided through an electronic copy.
Withdrawal is not retroactive and does not remove applicable retention obligations.
7. Website measurement and technologies
At this stage, the website is intended to operate without Google Analytics, Google Tag Manager, or advertising pixels.
The website may use local storage to remember your preferences, and providers may generate technical records necessary for operation and security. This does not constitute advertising tracking.
Before introducing measurement or advertising tools, we will review their data processing, update this notice, and implement the applicable consent controls.
8. Changes to this notice
Updates will be communicated by publishing the current version and its date in the privacy section of modeco.mx. If a change requires renewed authorization, we will request it before carrying out the relevant processing.
